In this article Ukrainian lawyer Stetsenko Yuriy examines historical aspects and current state of studying of circumstances about accused of a crime during criminal court proceeding. The examination of such circumstances by court is studied. Summary are made about using up by courts such circumstances for prescription of a penalty and release from serving punishment. Omissions in proving these circumstances are pointed.
